The Palestinian Association for Human Rights (Shahid) has released a specialized legal study titled "Legislation of Killing Under the Cover of the Knesset," providing an in-depth analysis of the draft law for the execution of Palestinian prisoners and tracking its legislative paths.
The release of this study is part of the organization's efforts to document the dangerous shifts in the occupation’s legislative system and to provide a reference for researchers and international organizations regarding attempts to legalize grave violations of the right to life and strip prisoners of fair trial guarantees.
The study clarified that the draft law has moved beyond the stage of political maneuvering to become a binding coalition clause approved in the first preliminary reading. It highlighted the fundamental amendments introduced by the proposal, most notably breaking the "judicial consensus" rule and sufficing with a simple majority to issue death sentences, while stripping military authorities of the power to commute sentences, making them final and non-reviewable.
The report also documented a series of executive measures initiated by the occupation authorities, most importantly:
•The establishment of the "Green Mile" complex.
•The adoption of "hanging" as the execution method.
•Granting executioners full criminal immunity.
The study refuted the law’s compliance with international conventions, particularly Article (6) of the International Covenant on Civil and Political Rights and Article (75) of the Fourth Geneva Convention, emphasizing that depriving protected persons of their right to a fair and regular trial constitutes a grave breach and is classified as a war crime.
Shahid concluded its study by calling on the international community and the Prosecutor of the International Criminal Court (ICC) to take urgent action to stop this legislative path, asserting the nullity of all laws issued by the occupation due to its illegality and lack of legal and sovereign jurisdiction over the occupied territories.
