The
Palestinian Association for Human Rights (Witness) condemns the deliberate
targeting of journalist Hassan Eslaih in an Israeli airstrike that hit the
Nasser Medical Complex in the city of Khan Younis, on May 13, 2025.
Witness
points out that Eslaih was receiving treatment at the hospital for severe
injuries sustained during an April 7 Israeli strike on a media tent located
next to the hospital. The occupation forces not only attempted to assassinate
journalist Hassan once, but deliberately targeted him a second time—this time
inside a medical facility while he was undergoing treatment.
Witness
asserts that this attack constitutes a double war crime: it deliberately
targeted an injured civilian journalist receiving treatment inside a medical
facility—an act clearly prohibited under international humanitarian law. The
assault constitutes a serious violation of Article 79 of the 1977 Additional
Protocol I, which protects civilian journalists during armed conflict. It also
breaches Article 85 which classifies the intentional targeting of civilians and
protected medical facilities as a war crime.
